The Illinois Appellate Court, 1st District, 5th Division, has reversed an order entered by Judges Sophia H. Hall and Thomas J. O’Brien in an action seeking to enforce a local zoning ordinance. Trial court erred in invalidating village special-use ordinance limiting Montessori school to maximum of 120 students on basis that ordinance was arbitrary and bore no substantial relationship to public health and welfare; in fact, village presented overwhelming evidence that nearby property values would diminish and that traffic hazards and noise pollution would increase if maximum were increased to 170, as court ordered.
