BOMA Chicago Announces Winners of 2011-2012 TOBY Awards

The Building Owners and Managers Association of Chicago (BOMA/Chicago) announced the winners of “The Outstanding Building of the Year” (TOBY) Awards at an awards gala over the weekend. The TOBY Awards are designed to recognize excellence in office building management across several categories based on building size and type. The buildings were judged on tenant relations, commitment to environmental sustainability, emergency preparedness, budgeting, work order systems, security standards, staff experience and continuing education opportunities.

The Chicago Energy Code Turns Ten

Ten years ago, the city of Chicago introduced its Energy Conservation Code, based largely on the International Energy Conservation Code (IECC). The 2001 Chicago Energy Code was written to increase savings by lessening energy drain both commercially and residentially.

In that time, it has been revised twice: in 2006 and 2009. These revisions have seen some modest gains in efficiency. The 2009 edition, for example, contains a 15% increase in overall energy savings beyond the 2006 book.

New Ordinance Encourages More Urban Farming

A new zoning code, approved at the last council meeting, will promote the expansion of community gardening and urban agriculture within the city boundaries.

The amendment, first introduced by Mayor Rahm Emanuel in July, recognizes urban farming and allows citizens or companies to apply for building permits and zoning approvals to help establish foundations in the urban agriculture sector. The ordinance legalizes urban farming of vegetables, fruits and fish and will permit owners to sell what they raise.

Chicago River Improvements Include New Boathouses, Pollution Controls

Mayor Rahm Emanuel announced on Monday a plan to enhance the Chicago River’s recreational appeal. The future development would be grounded by four new boathouses, several new boat launches, expansion of riverfront trails and pollution controls of the famed waterway.

Emanuel Looks to Clean Up Chicago Recycling

The City Council adopts the goal of making regular recycling service available by July 1, 1993, to 100 percent of the households in low-density dwellings served by the City of Chicago.

So begins the section of the Chicago Municipal Code regarding regular recycling service. To put that in perspective, Chicago Bulls fans were wearing out the word “threepeat” in July of 1993, the Unabomber was still on the loose and David Letterman was preparing his switch from NBC to CBS.

City Council Approves Gun Ranges in Chicago

The Chicago City Council voted last week to allow firing ranges to operate in the city under strict guidelines. Mayor Rahm Emanuel sent the ordinance directly to City Council’s Public Safety Committee, a bypass that is typically saved for emergencies.

Developer With Political Ties Gets Title to Lakeview Site

After two years of lengthy court battles, Allison Davis finally gained rights of the former Dominick’s site in Chicago’s Lakeview neighborhood. In 2009, Davis and Mayor Richard Daley’s nephew, Robert Vanecko, sought to auction off the site after a default loan by developers Michael O’Connor and Jonathan Zitzman.

Davis’ Urban Realty Partners was the lender in 2009 for a failed project to build a new Dominick’s and a residential housing complex at the site. In a deal that closed in March, a venture of DV Urban has taken title of the property through a $6.5 million loan from Chinese lender, Wanziang America Real Estate Group LLC. Initial plans suggest that the current parking lot will be redeveloped into a usable and functional space.

“DV Urban is in the process of talking with two grocers about a store there,” said Maureen Martino, executive director of the Lakeview East Chamber of Commerce. “A grocery store would be excellent news for the community, because the old Dominick’s was destroyed by a fire five years ago.”

“I cannot tell you how many people walk into our office and ask, ‘When is Dominick’s coming back?’” she said. “They really miss the grocery store.”

In addition to the grocery store, the plans propose some kind of residential complex, either apartments or condominiums.

Davis, head of Chicago-based Davis Group LLC, did not respond to questions seeking comment. The DV Urban fund provided a $7.9 million mezzanine loan for the project but gained attention in media reports for getting $68 million in investments from city pension funds.

The sale of the property ends roughly a two-year battle for the site from the preceding owners, Chicago developers Michael O’Connor and Jonathan Zitzman. In June 2009, the venture that owned the site filed for bankruptcy to prevent a foreclosure sale.

In the end, DV Urban was the highest bidder for the defaulted first mortgage. “They paid just more than $8 million, compared with the loan’s roughly $11 million balance,” said Paul Bauch of Chicago law firm Bauch & Michaels LLC, who represented the O’Connor – Zitzman venture in court.

“It’s a great development site located in a great area,” Bauch said. “It’s unfortunate that because of the economy, no one’s really doing anything.”
